When you are accessing or applying for a disabled parking badge you will need to provide us with some personal data or information.

As the 'data controller' for the personal information - or data - we hold about you, South Ayrshire Council decides how your personal information is used/processed, and what it is used for.

This statement provides more details about how we will use your personal data and provides information on how to get in touch with us if you need to know more.

Your personal data - what is it?

Personal data is information relating to a living person who can be identified from that data. Identification can be based on the information alone, or in conjunction with any other information. The processing of personal data is governed by the General Data Protection Regulation 2016 (GDPR) and supplemented by the Data Protection Act 2018.

What Personal Data will we collect from you?

The following personal data is collected as part of the Blue Badge application and assessment process:

Address
Contact Details
Town of Birth
Date of Birth
Email
Telephone number
Driving Licence Number
National Insurance Number
Vehicle registration numbers
Proof of Identity (e.g. birth certificate) and proof of address (e.g. council tax bill)
Payment details may be taken if you pay by card

We may need further special category (sensitive) personal data:

Disability
Heath conditions (including details of medical conditions affecting mobility, pain medication and assessment of walking ability)
Evidence to support automatic eligibility for a Badge (e.g. blind registration, payment of mobility allowances)

How will we use your information?

South Ayrshire Council may use your information for the following purposes:

For the administration and assessment of the Blue Badge application in accordance with governing legislation.
For the purposes of Blue Badge parking enforcement
For the prevention and detection of crime or fraud including data matching under the National Fraud Initiative

What is the legal basis for using/sharing your information?

The legal basis is it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller as per article 6(1) (e) of the GDPR. This is because we have a duty to provide disabled persons' badges under the Chronically Sick and Disabled Persons Act 1970 and the Disabled Persons (Badges for Motor Vehicles) (Scotland) Regulations 2000.

Where we process special categories of personal information about you, the processing is necessary for the purposes of carrying out obligations and exercising specific rights of the controller or of the data subject in the field of social protection law as set out in Article 9(2) (b) of the GDPR and meets a condition in Part 1 of Schedule 1 of the Data Protection Act 2018.

Who will we share your information with?

Your information may be shared with the following:

Ayrshire Roads Alliance parking enforcement team - this includes routine sharing of information on lost and stolen badges.
Other local authority Blue Badge enforcement teams
Police for parking enforcement
Your name, address, date of birth, contact information and blue badge details will be shared with the Cabinet Office for data matching under the National Fraud Initiative

If you move address to another local authority, your Blue Badge Registration record may be transferred if requested by the new Local Authority.

How long do we keep hold of your information?

The information will form part of your blue badge account, and held for:

1 year after badge valid from date
1 year for unsuccessful applications.

How do we keep your information secure?

The security of your personal information is important to us. This is why we follow a range of security policies and procedures to control and safeguard access to and use of your personal information.

All debit and credit card payments that we transact are encrypted to comply with the relevant statutory and financial requirements.

What are your rights?

The lawful basis for processing/using your personal data directly impacts which rights are available to you. For example, some rights will not apply, in this case we are not required to:

erase your personal information.
enable the right to data portability

However, you do have the following rights and can ask us to:

correct your personal information if it is inaccurate;
complete your personal information if it is incomplete;
restrict the processing of your personal information in certain circumstances

You also have the right to object to the processing of your personal information.

What are the consequences of failing to provide personal information?

Where the provision of your information to the Council is a statutory or contractual requirement, or a requirement necessary to enter into a contract, you are obliged to provide the information. Failure to provide the required personal data will result in the Council being unable to provide you with a Blue Badge.

What about Automated Decision- Making?

The Service does not use profiling or automated decision-making.
